The father who killed his 14-year-old daughter's rapist has had murder charges dropped following a police error.

In the US, a high-profile criminal case took a dramatic turn. Accused of killing a man involved in a case concerning his teenage daughter, a father saw the charges dropped after a crucial piece of evidence disappeared.

Can a criminal investigation be derailed by a single missing piece of evidence? In Arkansas, a high-profile case has just taken a dramatic turn. At the heart of the case: a father accused of killing a man being prosecuted for very serious crimes against his teenage daughter. While his trial was meant to establish the exact circumstances of the tragedy, an error made in the safekeeping of a crucial piece of evidence has changed everything.

A case that has shaken Lonoke County

Aaron Spencer, 37, became a particularly well-known figure in Lonoke County, Arkansas. A former law enforcement officer and sheriff candidate, he had himself been facing legal troubles since October 2024.

The man admitted to fatally wounding 67-year-old Michael Fosler, but denied the murder charges against him. According to his version of events, he intervened to protect his 13-year-old daughter, who had been reported missing during the night.

The case quickly attracted public attention due to the profile of the protagonists and the extremely serious accusations that were already leveled against Michael Fosler at the time of the events.

A worrying disappearance followed by a confrontation

Court documents indicate that Aaron Spencer and his wife woke up to find their daughter missing from their home. After contacting emergency services, they began their own search.

The couple suspected the teenager might be with Michael Fosler. A few months earlier, he had been arrested in an investigation involving dozens of criminal charges related to the girl. Despite these charges, he had been released on bail.

According to the case file, Aaron Spencer eventually spotted Fosler's vehicle with his daughter inside. A chase ensued before the two men came face to face on the side of the road.

It was during this confrontation that events escalated, leading to the death of Michael Fosler.

A potentially decisive piece of evidence disappears

One of the most important pieces of evidence in the investigation concerned a dashcam installed in Fosler's vehicle. Investigators believed it may have recorded all or part of the incident.

However, this evidence found itself at the center of an incredible imbroglio.

According to court documents, the device was indeed recovered at the scene by an investigator from the sheriff's office. However, he allegedly did not follow standard evidence preservation procedures. Instead of being immediately placed in the designated secure area, the equipment was reportedly kept in his office for an extended period.

Meanwhile, the battery had run out, resulting in the loss of some device settings. Even more problematic, when the camera was finally handed over to the experts tasked with analyzing it, the memory card that had been there when it was recovered was missing.

This was a particularly sensitive situation, as the images and audio recordings could have provided precise details of the confrontation.  According to the defense, this key evidence  could not be replaced or reconstructed by other means.
